Acceptance of Terms

By downloading, installing, or using the Just FYI application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

Just FYI is a privacy-first anonymous contact tracing application designed to help communities track potential health exposures while protecting user privacy. The App:

  • Creates anonymous identifiers for contact tracing
  • Records interactions with other Just FYI users via Bluetooth
  • Sends and receives anonymous exposure notifications
  • Stores interaction data on your device and syncs to our secure servers

User Responsibilities

Appropriate Use

You agree to use Just FYI only for its intended purpose of anonymous contact tracing. You agree not to:

  • Attempt to identify or de-anonymize other users
  • Use the App for harassment, stalking, or any malicious purpose
  • Interfere with or disrupt the App’s functionality
  • Reverse engineer or attempt to extract source code (except as permitted by the license)
  • Use the App in violation of any applicable laws

Accurate Reporting

When reporting an exposure:

  • You agree to report only genuine health exposures
  • False reports may result in termination of your access to the App
  • You understand that reports cannot be retracted once submitted

Device Security

You are responsible for maintaining the security of your device and the App. This includes:

  • Keeping your device software up to date
  • Not sharing your device with others who may misuse the App
  • Reporting any security vulnerabilities you discover

Privacy and Data

Your use of Just FYI is also governed by our Privacy Policy. By using the App, you consent to the data practices described therein.

Key points:

  • No personal information is collected
  • Interaction data is retained for 180 days (on device and servers)
  • You can delete your data at any time
  • Anonymous exposure notifications do not reveal identities

No Medical Advice

Just FYI is a communication and notification tool. It does not provide:

  • Medical advice or diagnosis
  • Treatment recommendations
  • Health care services

If you receive an exposure notification, please consult with a healthcare professional. The App is not a substitute for professional medical advice.

Intellectual Property

Source-Available License

Just FYI is source-available software. Our license permits:

  • Viewing and contributing to the codebase
  • Non-commercial use (personal projects, education, research)

Commercial use requires explicit written permission from the copyright holder.

Trademarks

The Just FYI name, logo, and branding are trademarks. The license does not grant rights to use these marks.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF NOTIFICATIONS

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Exposure notifications will be accurate or timely
  • All potential exposures will be detected
  • The App will work with all devices or operating systems

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JUST FYI, ITS DEVELOPERS, OR CONTRIBUTORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Health outcomes resulting from use or non-use of the App
  • Any damages exceeding the amount you paid for the App (which is zero)

This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Just FYI and its developers from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

Termination

By You

You may stop using Just FYI at any time by uninstalling the App. No further action is required.

By Us

We reserve the right to:

  • Discontinue the App at any time with or without notice
  • Block or terminate access for users who violate these Terms
  • Modify or remove features from the App

Upon termination:

  • All data stored locally on your device remains there until you delete it
  • Your anonymous identifier becomes inactive
  • You will no longer receive exposure notifications

Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted. Continued use of the App after changes constitutes acceptance of the new Terms.

We will make reasonable efforts to notify users of significant changes through:

  • In-app notifications
  • Updates to the “Last Updated” date

Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles. For users in the European Union, mandatory consumer protection laws of your country of residence may also apply.

Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through:

  1. Good faith negotiation
  2. Mediation (if negotiation fails)
  3. Courts of competent jurisdiction in Berlin, Germany

For EU consumers, you may also use the European Commission’s Online Dispute Resolution platform.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Just FYI regarding your use of the App.
